These online terms and conditions relate to APT Kimberley Wilderness Adventures (as part of the APT Group), herein after referred to as The Company.

Fares, Booking Confirmations
A $200 deposit per person, per tour is required at time of booking. The balance of any airfares booked by The Company is required within seven days of booking. Some seasonal special offers may require an additional deposit, which will be advised at the time of reservation. Balance is required six weeks before departure (tours including rail travel 60 days prior). Where connecting air, rail or boat travel is included, confirm correct fare at time of paying balance. If booking is made within 42 days of departure, full payment is required at time of booking.

All fares quoted are in Australian currency and supersede all prices previously advertised. Stated duration counts day of departure and day of return. Twin share prices are per person unless otherwise stated. The Company reserves the right to cancel any ticket or booking or to refuse to carry any passenger where payment has not been received by The Company within the specified time. Prices include Australian Government Goods and Services Tax (where applicable).Discounts: APT Club offers may be combined with some other discounts. Please ask at the time of booking for more details.

Children under 15 (under 12 for Independent Air Safaris):
When sharing with one adult, discount is 20% off adult fare. Children under 7 years of age are not recommended to participate in tours. Children under 18 years must be accompanied by an adult.

Concession fares: Apply to Australian and New Zealand pensioners and Australian Seniors Card Holders. Refer to fare tables for relevant discounts.

Cancellation Policy
Notice (in days) 42 or more 16-41 1-15
% fee of fare loss of deposit 20% 100%
If tour has commenced, no refund of fare or unused portion.
Cruising Expeditions Cancellation Policy
Notice (in days) 60 or more 30-59 1-29
% fee of fare loss of deposit 50% 100%
If cruise has commenced, no refund of fare or unused portion.

Luggage Limits
Touring is in small 4WD vehicles with limited luggage capacity.
Each passenger is requested to limit their luggage to one small/medium soft bag or suitcase weighing no more than 16 kg (35lb approx). Cameras, make up bag etc. should be carried separately.
Air travel within the Kimberley is in a small aircraft which has to comply with very strict total weight limits (for both passengers and luggage). For tours entailing air travel, only luggage and personal effects up to 10 kg can be guaranteed carriage on the aircraft. For air safari packages from Kununurra, excess luggage can
be left with hotel or stored at the airline terminal. For Kimberley cruises/Bungle packages, excess luggage may entail special charter of aircraft or helicopter. The additional cost of this will be passed on to thepassenger.

Important Information Exclusion of Liability
1. Whilst The Company will take all reasonable steps to provide an enjoyable tour, it accepts no liability for any loss of enjoyment experienced by passengers due to circumstances beyond its control. The Company further accepts no liability for any loss beyond its reasonable control and limits its liability to the amount of the tour or cruise price paid by you, or provision of replacement product, and provides no warranties in addition to those set out under the Trade Practices Act 1974. Nothing herein restricts any passenger from exercising their rights and remedies pursuant to law.
2. Your travel agent will forward booking confirmations and other payments to us on your behalf, but your travel agent is not our agent for the purpose of receipt of monies. Receipt of booking confirmations and subsequent payments by the travel agent does not constitute receipt of those monies by
us and the travel agent has no authority expressed or implied to receive monies on our behalf. There is no liability on the part of The Company in respect to any monies paid to the passenger's travel agent unless and until The Company notifies the passenger (by way of a booking confirmation advice or payment receipt advice) that monies have been received by The Company.
3. The optional tour excursions are not operated by or at
the direction or on behalf of The Company or its employees
or agents or any other persons or companies associated with
The Company. By taking bookings for these tours, The Company acts as each optional tour operator's agent.
4. These tours include the services of operators other than
The Company e.g. hoteliers, airlines and optional tour excursions, which are not under the direct control of The Company, and whilst The Company takes all reasonable care in selecting these operators, it cannot accept responsibility for those operators' conduct or the conduct of their representative employees or agents or for any ramifications of that conduct.
5. On tours including trekking, swimming and snorkelling etc., passengers accept that degrees of risk are involved.
6. No passenger will be permitted to embark or continue on tour while their mental or physical condition is, in the opinion of any representative of The Company, such as to render them incapable of caring for themselves, or whereby they become objectionable to other passengers, or they become a hazard to themselves or other passengers. The Company will not be responsible for expenses resulting in such persons being precluded from completing the tour.

Amendment Fees
A charge of $25 will apply to any addition or modification requested after the original booking has been confirmed.

Itineraries are subject to alteration without notice and intended as a guide only. Alterations may come about due to road, weather or tidal conditions, strikes, public holidays, local festivals or other reasons. Due to the nature of the terrain and remote areas, weather fluctuations can adversely affect road conditions which may necessitate alterations to itinerary with little or no notice. Any additional expense incurred by the passenger is not The Company's responsibility. The Company can give no guarantee as to the exact arrival and departure times for carriers and operators used by The Company in the tour and The Company will not be liable for failure to make connections with any other services or attractions beyond its control. As is normally the case with group tours, a minimum number of bookings is required in order for a tour to be financially viable and to have a pleasant group atmosphere. In the event that adequate numbers cannot be achieved, it may be necessary to cancel a scheduled departure and to offer the nearest possible alternative date (or a full refund of monies paid for APT ground content touring). The date on which the decision is made whether a tour will operate is usually 4-8 weeks before the scheduled departure date.

Government regulations forbid smoking in tourist vehicles, however frequent stops are made for those wishing to smoke. Smoking is not permitted in twin share 'matched' rooms, tents or lodges. Requests for smoking/non smoking accommodation will be passed on to hotels but cannot be guaranteed.

Health and Fitness
As tours visit remote areas and feature activities with varying degrees of difficulty, it is vital to select a tour with an activity level suited to your health and fitness. It is your responsibility to carry any medication you require for the tour's duration.
We recommend carrying medication in your hand luggage from the time you leave home.

Seat Allocation on Tours
To ensure all passengers enjoy forward and window facing seats, we have incorporated a daily seat rotation system.

Service Inquiries
If a problem occurs during your tour, then in your own best interests, you should advise your Driver/Guide so that steps can be taken to resolve the matter there and then. If you remain dissatisfied, any complaint must be made in writing to us within 30 days.

Travel Pack &?Day Kit
Each passenger receives a Day Pack on joining tour. Each couple/single supplement traveller receives one
set of binoculars and souvenir Kimberley map. Excludes Independent Air Safaris.

Travel Insurance
We strongly recommend passengers to take out travel insurance to cover any unforeseen circumstances which may arise (including cancellation fees, medical and curtailment expenses, loss of luggage, early departure from tour due to death or illness etc.). Ask your Travel Agent for details at the time of booking.
